Once a receiver is appointed, the asset the receiver is managing is said to be in receivership. The receiver/receivership is responsible for: Securing the assets of the company. Realizing the assets of the company. Managing the affairs of the company. Selling or liquidating the assets/company to find maximum relief of the debt.WHAT ARE THE BENEFITS OF USING RECEIVERSHIP? Receivership is the quickest way to gain control, market, and dispose of an asset rather than the property foreclosing. Receivership also assists and provides protection to the lenders from issues surrounding the chain of title, safeguards the value of the asset, provides insulation from liabilities, and can ultimately generate a higher return than foreclosure. WHY USE A RECEIVERSHIP? Without the use of a court-appointed safeguard of receivership, distressed assets that are left in the control of the defaulting borrowers lose their value due to the lack of maintenance and repairs, collected rents fail to be applied to the note , and tenants defect to better managed properties.
